Empirean, Inc. respects the intellectual property rights of others and takes copyright infringement seriously. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy for addressing repeat infringers.


What Is a Repeat Infringer?

A repeat infringer is a user who has been the subject of multiple valid DMCA takedown notices. Empirean, Inc. tracks these notices and takes appropriate action as described below.


Our Policy

  1. Tracking Infringements:
    We maintain a record of DMCA takedown notices associated with user accounts.
  2. Warning System:
    • Upon receiving a first valid DMCA takedown notice, we will notify the user and may issue a warning.
    • For subsequent valid takedown notices, additional warnings may be issued, or further action may be taken.
  3. Account Termination:
    Users who are determined to be repeat infringers may have their accounts suspended or terminated, at our discretion.
  4. Appeals:
    Users may appeal actions taken against their accounts if they believe the notices were issued in error. Appeals can be submitted to takedown-appeals@empirean.tech.

Exceptions and Considerations

Empirean, Inc. reserves the right to make exceptions to this policy in cases where we believe the notices were submitted in bad faith or where mitigating circumstances exist. Additionally, we may reinstate accounts if evidence shows that the notices were invalid.
